In deze voorwaarden gelden de volgende definities:<\/span><\/p>

  1. Bedenkperiode <\/strong>: de periode waarbinnen de consument zijn recht op annulering kan uitoefenen;<\/span><\/li>
  2. Consumer:<\/strong> the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;<\/span><\/li>
  3. Dag : <\/strong>kalenderdag;<\/span><\/li>
  4. Duurtransactie :<\/strong> een afstandsovereenkomst betreffende een reeks producten en\/of diensten, waarvan de levering en\/of aankoopverplichting over de tijd is gespreid;<\/span><\/li>
  5. Duurzaam medium :<\/strong> elk middel dat de consument of ondernemer in staat stelt om informatie die aan hem persoonlijk is gericht op een manier op te slaan dat toekomstige raadpleging en ongewijzigde weergave van de opgeslagen informatie mogelijk is.<\/span><\/li>
  6. Recht op annulering : <\/strong>de mogelijkheid voor de consument om de afstandsovereenkomst binnen de bedenkperiode te ontbinden;<\/span><\/li>
  7. Modelformulier :<\/strong> het modelformulier voor annulering dat de ondernemer beschikbaar stelt en dat een consument kan invullen wanneer hij zijn recht op annulering wil uitoefenen.<\/span><\/li>
  8. Ondernemer : <\/strong>de natuurlijke of rechtspersoon die producten en\/of diensten op afstand aan consumenten aanbiedt;<\/span><\/li>
  9. Afstandsovereenkomst : <\/strong>een overeenkomst waarbij, binnen het kader van een door de ondernemer georganiseerd systeem voor de verkoop op afstand van producten en\/of diensten, uitsluitend gebruik wordt gemaakt van \u00e9\u00e9n of meer technieken voor communicatie op afstand tot en met het sluiten van de overeenkomst;<\/span><\/li>
  10. Afstandscommunicatietechniek :<\/strong> een middel dat kan worden gebruikt om een overeenkomst te sluiten zonder dat de consument en de ondernemer tegelijkertijd in dezelfde ruimte aanwezig zijn.<\/span><\/li>

    Artikel 3 \u2013 Toepasselijkheid <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

    1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke afstandsovereenkomst en bestellingen tussen de ondernemer en de consument.<\/li>
    2. Voordat de afstandsovereenkomst wordt gesloten, zal de tekst van deze algemene voorwaarden aan de consument ter beschikking worden gesteld. Als dit redelijkerwijs niet mogelijk is, zal voordat de afstandsovereenkomst wordt gesloten worden aangegeven dat de algemene voorwaarden bij de ondernemer kunnen worden ingezien en dat zij kosteloos zo spoedig mogelijk op verzoek van de consument zullen worden toegezonden. <\/li>
    3. Als de afstandsovereenkomst elektronisch wordt gesloten, onverminderd het voorgaande en voordat de afstandsovereenkomst wordt gesloten, kan de tekst van deze algemene voorwaarden aan de consument elektronisch ter beschikking worden gesteld op een wijze dat deze gemakkelijk op een duurzaam medium kan worden opgeslagen. Als dit redelijkerwijs niet mogelijk is, zal voordat de afstandsovereenkomst wordt gesloten worden aangegeven waar de algemene voorwaarden elektronisch kunnen worden ingezien en dat zij kosteloos elektronisch of anderszins op verzoek van de consument zullen worden toegezonden. <\/li>
    4.       Artikel 4 \u2013 Het aanbod <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

        1. Als een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden is gedaan, zal dit uitdrukkelijk in het aanbod worden vermeld.<\/li>
        2. Het aanbod is vrijblijvend. De ondernemer is gerechtigd het aanbod te wijzigen en aan te passen. <\/li>
        3. Het aanbod bevat een volledige en juiste beschrijving van de aangeboden producten en\/of diensten. De beschrijving is voldoende gedetailleerd om de consument in staat te stellen een goede inschatting van het aanbod te maken. Als de ondernemer gebruik maakt van afbeeldingen, zijn deze een getrouwe weergave van de aangeboden producten en\/of diensten. Voor de hand liggende fouten of fouten in het aanbod binden de ondernemer niet. <\/li>
        4. Alle afbeeldingen en specificaties in het aanbod zijn indicatief en kunnen geen grond vormen voor schadevergoeding of ontbinding van de overeenkomst.<\/li>
        5. Afbeeldingen van producten zijn een getrouwe weergave van de aangeboden producten. De ondernemer kan niet garanderen dat de weergegeven kleuren exact overeenkomen met de werkelijke kleuren van de producten. <\/li>
        6. Elk aanbod bevat zodanige informatie dat het de consument duidelijk is welke rechten en verplichtingen zijn verbonden aan het accepteren van het aanbod.<\/li><\/ol>

          Hierbij gaat het met name om:<\/strong><\/span><\/p>

          • de prijs inclusief belastingen;<\/li>
          • eventuele verzendkosten;<\/li>
          • de wijze waarop de overeenkomst zal worden gesloten en welke handelingen hiervoor nodig zijn;<\/li>
          • of het recht op annulering al dan niet van toepassing is;<\/li>
          • de wijze van betaling, levering en uitvoering van de overeenkomst;<\/li>
          • de periode voor acceptatie van het aanbod, of de periode waarbinnen de ondernemer de prijs gegarandeerd;<\/li>
          • het tarief voor afstandscommunicatie indien de kosten voor het gebruik van de techniek voor afstandscommunicatie op een andere basis worden berekend dan het gewone basistarief voor de gebruikte communicatiemiddelen;<\/li>
          • of de overeenkomst na afloop wordt gearchiveerd en, zo ja, waar deze door de consument kan worden geraadpleegd;<\/li>
          • de wijze waarop de consument, voordat de overeenkomst wordt gesloten, de door hem verstrekte gegevens in het kader van de overeenkomst kan controleren en, indien gewenst, herstellen;<\/li>
          • eventuele andere talen waarin, naast het Nederlands, de overeenkomst kan worden gesloten;<\/li>
          • de gedragscodes waaraan de ondernemer zich heeft onderworpen en de wijze waarop de consument deze gedragscodes elektronisch kan raadplegen;<\/li>
          • en de minimale looptijd van de afstandsovereenkomst in geval van een langdurige transactie.<\/li><\/ul><\/li><\/ol><\/div><\/div><\/div><\/div><\/div><\/section>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

            Article 5 \u2013 The agreement <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
            \n\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t
              1. The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and compliance with the conditions set.<\/li>
              2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as the agreement of this acceptance has not been confirmed by the entrepreneur, the consumer can terminate the agreement. <\/li>
              3. If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures. <\/li>
              4.                     Article 6 \u2013 Right of withdrawal <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

                      1. When delivering products:<\/span><\/p>

                        1. When purchasing products, the consumer has the option to terminate the agreement without giving reasons within 14 days. This reflection period commences on the day after receipt of the product by the consumer or a representative designated in advance by the consumer and made known to the entrepreneur. <\/li>

                              1. If the consumer exercises his right of withdrawal, a maximum of the costs of return will be borne by him.<\/li>
                              2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than within 14 days after cancellation. This is subject to the condition that the product has already been received back by the online retailer or that conclusive proof of complete return can be provided. Refunds will be made via the same payment method used by the consumer unless the consumer expressly consents to another payment method. <\/li>

                                1. De ondernemer kan het herroepingsrecht van de consument uitsluiten voor producten zoals omschreven in lid 2 en 3.                                   • Exclusion of the right of withdrawal is only possible for services:
                                    • regarding accommodation, transport, restaurant business or leisure activities to be carried out on a certain date or during a certain period;<\/li>
                                    • the delivery of which has started with the express consent of the consumer before the cooling-off period has expired;<\/li>
                                    • concerning betting and lotteries.<\/li><\/ul><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

                                      1. During the period of validity stated in the offer, the prices of the products and\/or services offered will not be increased, except for price changes as a result of changes in VAT rates.<\/li>

Notwithstanding the previous paragraph, the entrepreneur may offer products or services with variable prices, the prices of which are subject to fluctuations in the financial market and over which the entrepreneur has no influence.                                       3. Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of legal regulations or provisions.<\/li>

                                          1. The entrepreneur guarantees that the products and\/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and\/or usability and the legal provisions existing on the date of the conclusion of the agreement and\/or government regulations . If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use. <\/li>
                                          2. A guarantee provided by the entrepreneur, manufacturer or importer does not affect the legal rights and claims that the consumer can assert against the entrepreneur under the agreement.<\/li>
                                          3. Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 2 months of delivery. Products must be returned in the original packaging and in new condition. <\/li>
